The Rajya Sabha on weekday approved the urban center Territory Governance (Amendment) Bill 2021 (NCT Bill) amid significant opposition from the opposition, that lays down a number of the roles and rights of the elected official of Delhi. once the passage of this bill, the elected official of Delhi can get a lot of power. Earlier, this bill has been passed within the Lok Sabha on twenty two March. At a similar time, currently it’ll take the form of law once the signature of the President. once the introduction of this law, the opposition created a large furore within the House.
After the passage of the Bill from the Rajya Sabha, the Aam Aadmi Party has known as it a black day for democracy. Delhi CM Arvind Kejriwal same that the GNCTD bill was passed within the Rajya Sabha. it’s a dark day for Indian democracy. we’ll continue our struggle to bring back power to the folks. no matter obstacles come back, we’ll still benefit work. Work can neither stop nor weigh down.
Delhi Deputy CM Manish Sisodia tweeted that nowadays could be a black day for democracy. The rights of the govt elective by the folks of Delhi were stripped and handed over to LG. examine the irony that Parliament was elective to assassinate democracy, that is that the temple of our democracy. The folks of Delhi can fight against this Caesarism.
At a similar time, whereas responding to the discussion on the Bill within the higher House, Minister of State for Home Affairs Kishan Reddy same that as per the Constitution, Delhi could be a Union Territory with restricted powers. The Supreme Court has conjointly same in its judgment that it’s a Union Territory. All amendments adjust to the choice of the court.
Reddy said that under Article 239-A of the Constitution, the President appoints the Lieutenant Governor for Delhi. He said that if there is a difference of opinion between the Lieutenant Governor and the elected Government of Delhi on a subject, then the Lieutenant Governor informs the President about it. He said that he wants to assure the people of Delhi that no authority of the Delhi government has been curtailed. He said that Delhi Legislative Assembly has limited legislative powers.
Following the Minister’s reply, the House approved the National Capital Territory Governance (Amendment) Bill 2021 (NCT Bill) by voice. During this time, several opposition parties including Congress, BJD, SP, YSR walked out of the House. Leader of Opposition Mallikarjun Kharge said that he was not satisfied with the government’s response to the bill and hence his party was calling for a house. Minister of State for Home said that Delhi Legislative Assembly can legislate on every subject of the state and concurrent list except public order, police and land.
He said, “The Narendra Modi government is not taking any of those rights (through this bill) under the Constitution, which the Delhi government has.” Reddy said that the purpose of this amendment is the ambiguity in the original bill. It has to be removed so that the law cannot be challenged in various courts. He cited a 2018 order of the Supreme Court stating that the Lieutenant Governor would have to inform all decisions, proposals and agendas. If there is a difference of opinion on a matter between the Lieutenant Governor and the Council of Ministers, then the Lieutenant Governor can refer the matter to the President.
